Dear Mr. Morris: In your letter dated June 20, 2001, on behalf of Cooper Lighting, you requested a tariff classification ruling. The samples submitted consist of the following lighting parts: a live end connector (the Halo L982P), measuring approximately 7 ½ inches long, that is used to complete an electrical connection with the power track of a track lighting system. a metal light diffuser, item number L1967P, which is known as the Barn Door Shutter. It is made up of a flat metal O-ring shaped section with the attachment of four perforated adjustable metal shields. This article is designed to be affixed onto the top portion of a spotlight (a model in the Halo line of lights) for the diffusion of light. It is stated that the merchandise should be classified as lamp parts under subheading 9405.99.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other metal lamp parts. However, since the live end connector is more specifically provided for making electrical connections, consideration of classification under subheading 9405.99.4000, HTS, is precluded. The applicable subheading for the live end connector, Halo L982P, will be 8536.90.8085, Harmonized Tariff Schedule of the United States (HTS), which provides for other apparatus for making connection to or in electrical circuits, for a voltage not exceeding 1,000 V. The general rate of duty will be 2.7 percent ad valorem. The applicable subheading for the metal light diffuser, item number L1967P, will be 9405.99.4000, HTS, which provides for lamps and lighting fittings…not elsewhere specified or included…and parts thereof not elsewhere specified or included: parts: other: other. The general rate of duty will be 6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
