Isis Avenue, Suite 201 Inglewood, CA 90301 RE: The tariff classification of a baby’s diaper cover from Hong Kong Dear Ms. Breit: In your letter dated May 17, 2001 you requested a tariff classification ruling, on behalf of your client, Baby LuLu, Inc. Style 711 is a pull-on diaper cover made from a fine rib knit fabric that you state is 100% cotton. This diaper cover has a covered elasticized waistband and elasticized leg openings. You have indicated that this diaper cover will be imported in sizes 0-23 months. The applicable subheading for the diaper cover will be 6111.20.6040, Harmonized Tariff Schedule of the United States (HTS), which provides for Babies’ garments and clothing accessories, knitted or crocheted: Of cotton: Other: Other: Other: Other. The rate of duty will be 8.2 percent ad valorem. Style 711 falls within textile category designation 239. Based upon international textile trade agreements, this item from Hong Kong in category 239 is not subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
