Box 66760 St. Louis, Missouri 63166-6760 RE: The tariff classification of Resimene 872 from Canada. Dear Ms. Pierce: In your letter dated March 26, 1999, you requested a tariff classification ruling. Based on the technical literature submitted, Resimene 872 is an iso-butylated melamine-formaldehyde resin solution composed of approximately 48-52 percent resin, 44-48 percent iso-butanol and 4.5 percent formaldehyde, by weight. The applicable subheading for the Resimene 872 will be 3909.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Amino-resins, phenolic resins and polyurethanes, in primary form: Melamine resins. The rate of duty will be 6.5 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which is administered by the U.S. Environmental Protection Agency.
