Issued August 1, 2019 by U.S. Customs and Border Protection.

Tariff classification

HTS codes: 8302.50.0000

Headings: 8302

GRI rules applied: GRI 3

Product description

When fully extended, the rack measures 3 inches deep, by 26.75 inches wide, by 51.5 inches high. The rack consists of a molded polypropylene side frame with steel horizontal powder coated tubes. The frame can fold via a hinge in the middle of the rack which can be locked by a knob made of Acrylonitrile butadiene styrene (ABS) plastic. The primary material of the Spacemaker Drying Rack is steel which makes up 63.6 percent of the weight and 53 percent of the cost. The Spacemaker Drying Rack, item number 6036-5924 is composed of different components (steel, polypropylene, and ABS plastic) and is considered a composite good. The Explanatory Notes to the HTSUS, GRI 3 (b) (VIII), state that the factor which determines essential character will vary between different kinds of goods. It may for example, be determined by the nature of the materials or components, its bulk, quantity, weight or value, or by the role of a constituent material in relation to the use of the goods. When the essential character of a composite good can be determined, the whole product is classified as if it consists only of the material or component that imparts the essential character to the composite good. Consequently, we find that the steel component imparts the essential character.
