Burr Blvd., Suite 10 Teaneck, NJ 07666 RE: The tariff classification of “ORGA 1000 K-750 BLACK” from Japan Dear Ms. Bowman: In your letter received April 26, 2016, you requested a tariff classification ruling on “ORGA 1000 K-750 BLACK.” You have indicated that the product at issue is a phenol alkyd resin paint, intended to be used by the U. S. automotive industry. Your submission describes “ORGA 1000 K-750 BLACK” as a fully formulated liquid paint, dispersed in a nonaqueous medium. The applicable subheading for “ORGA 1000 K-750 BLACK” will be 3208.20.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Paint and varnishes (including enamels and lacquers) based on synthetic polymers or chemically modified natural polymers dispersed or dissolved in a nonaqueous medium; solutions as defined in note 4 to this chapter: Based on acrylic or vinyl polymers. The general rate of duty will be 3.6 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
