Burr Blvd., Suite 10 Teaneck, NJ 07666 RE: The tariff classification of “HI-DISPER ZG-48” (plastic dispersion) from Japan Dear Mr. Sekiguchi: In your ruling request dated December 2, 2011, on behalf of Nippon Paint (US) Inc., you requested a tariff classification ruling on “HI-DISPER ZG-48” (plastic dispersion). In your submission, you state that the product will be used as an anti-scratch additive in a solvent interior coating. The mixture is described as 7.5% polyolefin, 7.5% polytetrafluoroethylene, and 85% n-butyl acetate. The applicable subheading for “HI-DISPER ZG-48” (plastic dispersion) will be 3208.20.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Paint and varnishes (including enamels and lacquers) based on synthetic polymers or chemically modified natural polymers dispersed or dissolved in a nonaqueous medium; solutions as defined in note 4 to this chapter: Based on acrylic or vinyl polymers. The rate of duty will be 3.6 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
