Dear Ms. Stemley: In your letter dated June 09, 2014, you requested a tariff classification ruling. The samples submitted will be returned. The first sample submitted, which you state is style 057-1678, and called “Thermolene Pant” is a woman’s long underpants constructed from what you state is 95% polyester, 5% spandex knit mesh fabric. The undergarment features a crew neckline, flat lock stitching at the seams, a hemmed bottom, hemmed arm openings and is moisture wicking. The applicable subheading for style 057-1678 will be 6108.92.0005, HTSUS, which provides for women’s or girls’ slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted, other, of man-made fibers…underwear, underpants.
