Dear Mr. Levinsohn: In your letter dated November 14, 2008, you requested a tariff classification ruling. Photographs and description have been submitted for a cushioned headboard, style number SHB774. The item consists of a wood board component completely covered in foam padding and non-woven polypropylene fabric. The headboard is supported and will be connected to the bed frame with metal verticals. The item will be imported unassembled with padded headboard, verticals and hardware in retail packaging. The applicable subheading for the headboard will be 9403.90.6000 , Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other furniture and parts thereof: Parts: Other: Of textile material, except cotton.” The rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
