The eBike is 68 inches long, 42 inches high, 24 inches wide and travels on 18-inch diameter wheels. It uses four (4) 12-volt batteries with a 12-amp capacity to power the 350-watt electric DC motor.

The items concerned are two (2) electric vehicles which you have identified in your Ruling Request as the “ezride eBike” and “eScooter”. Both vehicles are powered by electric motors rated at 350 watts with additional manual power generated by pedals. The eBike is an electric/pedal powered moped. The eBike is 68 inches long, 42 inches high, 24 inches wide and travels on 18-inch diameter wheels. It uses four (4) 12-volt batteries with a 12-amp capacity to power the 350-watt electric DC motor. You state in your ruling request that the eBike has a maximum speed, using only the ancillary motor as propulsion, of 20 miles per hour. The eScooter is an electric/pedal powered moped. The eScooter is 62 inches long, 39 inches high, 24 inches wide and travels on 16-inch diameter wheels. It uses four (4) 12-volt batteries with a 12- amp capacity to power the 350-watt electric DC motor. You state in your ruling request that the eScooter has a maximum speed, using only the ancillary motor as propulsion, of 20 miles per hour. The applicable classification subheading for both the ezride eBike and eScooter will be 8711.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Motorcycles (including mopeds) and cycles fitted with an auxiliary motor, with or without side-cars … : Other”. The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change. The text of the most recent Harmonized Tariff Schedule of the United States and the accompanying duty rates are provided on the World Wide Web at http://ww.usitc.gov /tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
