The subject merchandise is item 0959940-061 described as “Belgian Chocolate Powder”. It is said to contain 50.30 percent sugar, 45.62 percent cocoa liquor, and 4.07 percent cocoa powder. The total percentage of nonfat solids of cocoa powder is 3.62 percent. The product will be shipped in 50-pound cardboard cases with a single plastic liner. It is intended for use as an ingredient in bakery products. If the quantitative limits of additional U.S. note 8 to chapter 17 have been reached, the product will be classified in subheading 1806.20.9800, HTSUS, and dutiable at the rate of 37.2 cents per kilogram plus 8.5 percent ad valorem. In addition, products classified in subheading 1806.20.9800, HTSUS, will be subject to additional duties based on their value, as described in subheadings 9904.17.49 to 9904.17.56, HTSUS. Duty rates are provided for your convenience and are subject to change.
