Dear Mr. Forbes: In your letter dated November 13, 2006, on behalf of Barry Callebaut Canada, of Hyacinthe, Quebec, you requested a tariff classification ruling. The subject merchandise is stated to contain: 47.42 percent chocolate liquor, 45.52 percent sugar, 3.04 percent cocoa butter, 2.83 percent anhydrous dextrose, 0.73 percent cocoa powder, 0.29 percent soya lecithin, and 0.15 percent vanillin. The semi sweet chocolate chunks will be imported in boxes exceeding 2 kilograms. The semi sweet chocolate chunks are to be used in baking. The general rate of duty will be 10 percent ad valorem. If the quantitative limits of additional U.S. note 8 to chapter 17 have been reached, the product will be classified in subheading 1806.20.9800, HTSUS, and dutiable at the rate of 37.2 cents per kilogram plus 8.5 percent ad valorem. In addition, products classified in subheading 1806.20.9800, HTSUS, will be subject to additional duties based on their value, as described in subheadings 9904.17.49 to 9904.17.56, HTSUS.
