Hartill Capital Transportation Customs Clearance Services, Inc. 167-18 146th Avenue Jamaica, NY 11434 RE: The tariff classification of travel tote bags from China Dear Mr. Harill: In your letter dated May 31, 2006, you requested a tariff classification ruling on behalf of Ballet Makers, Inc., of Totowa, New Jersey. The submitted samples are two travel tote bags, identified as Style #B12 Capezio Cares Logo Bag and Style #B13C Princess Bag. Style #B12 Capezio Cares Logo Bag is a travel tote bag that measures approximately 6 ½” wide by 13” deep by 15½”across. It is constructed with an exterior surface of man-made fiber fabric. It features a zippered top, two adjacent elastic open interior pockets, and two carrying straps that allow the bag to be carried on the shoulder, under the arm. The applicable subheading for the Style #B12 travel tote will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides, in part, for travel, sport, and similar bags, with outer surface of textile materials, of man-made fibers. The rate of duty will be 17.6% ad valorem. Style #B13C Princess Bag has an exterior that is 100% covered with plastic sheeting (including two clear “windows”) except for end panels of mesh fabric. The bag measures approximately 6½” wide by 6½”deep x 9½” across. It features a zippered top lid, open pockets on three exterior sides, two adjacent elastic open pockets inside, and a zipper compartment on the bottom. It has two plastic carrying handles. The applicable subheading for Style #B13C will be 4202.92.9060, HTSUS, which provides, in part, for other bags and containers, with outer surface of textile materials or of a sheeting of plastic, other. The rate of duty will be 17.6% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The samples will be returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
