Descriptive literature was submitted. The article in question is identified as the “ScentCube” and described as an ambient fragrance device/system. Based on the information made available, the ScentCube is an electric fan specially designed to produce a scented airflow. The housing of the ScentCube is designed to accept a container of fragrant gel. As the gel evaporates it produces a fragrant scent that is then circulated by the fan. You indicate that the ScentCube is generally shipped without the fragrant gel. The applicable subheading for ScentCube, whether or not presented with the fragrant gel, will be 8414.59.6095, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other fans. The rate of duty will be 2.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
