Dear Ms. Ritchings: In your letter dated October 9, 2003 you requested a tariff classification ruling. The item in question is a battery operated AM/FM clock radio with a CD player. This ruling pertains to the model that is in the form of a miniature “Hummer” vehicle. A sample has been submitted that is of a miniature “Volkswagen Beetle” vehicle. It has been indicted that the sample represents the same exact audio features for the model type requested in this ruling. This office will base its classification on those facts. The submitted sample will be returned as requested by Conair Corporation. The device is a fully functional radiobroadcast receiver capable of receiving radiobroadcasts on either AM or FM channels and it incorporates in the same housing an audio CD player that is not capable of recording. The device also contains a digital alarm clock that displays the time on a self contained LCD screen.
