Dear Mr. Larian: In your letter dated February 21, 1997, you requested a tariff classification ruling. The sample submitted, item number 230137, is a portable battery operated combination AM/FM radio/flashlight in a plastic housing. It measures seven inches in length and has an attached wrist strap. The features consist of an AM/FM radio, frequency tuner, volume/power tuner, power indicator light, belt clip, speaker, and flashlight. The applicable subheading for this radio will be 8527.19.5045, Harmonized Tariff Schedule of the United States (HTS), which provides for reception apparatus for radiotelephony...: radiobroadcast receivers...: other: other...other: other. The rate of duty will be 4.2 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
