Dear Ms. Powell: In your letter dated March 24, 2003, you requested a classification ruling. The submitted sample is identified as item number 032101. This red and white glass Christmas tree ornament is fashioned with a raised figure of Santa surrounded with gifts on each side of the ornament. A red textile ribbon bow is attached to the top with a string for hanging the ornament on a Christmas tree. Your letter of inquiry states that the primary use of the ornament will be in Christmas floral arrangements. The applicable subheading for the glass Christmas ornament will be 9505.10.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Of glass. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
