Dear Ms. Wierbicki: In your letter dated September 13, 2002, on behalf of Avon Products, Inc., you requested a tariff classification ruling. As requested, the sample will be returned to you. The submitted sample, style 248493 is described as a chenille scarf (boa) and headband that will be imported and packaged for retail sale together as a set. The boa and the headband are constructed of 100% polyester knit fabric. The boa and headband meet all of the criteria for classification as a set. Neither component imparts the essential character. The boa would be classifiable under 6117.10 HTS and the headband under 6117.80 HTS. Classification will be pursuant to GRI 3 (c) under the heading which occurs last in numerical order in the HTS. Therefore, classification will be under the subheading 6117.80, HTS.
