FV-2002064 Apricot Infused Vinegar consists of whole apricots in a liquid medium of vinegar, citric acid, salt, sodium sulfite, sodium benzoate, and potassium sorbate, packed in four-sided, clear glass bottles measuring approximately 17 inches tall. Laboratory analysis found the product to contain 6.2 percent acetic acid.

Dear Mr. Harper: In your letter dated February 16, 2000, you requested a tariff classification ruling. A sample and illustrative literature accompanied your letter. The sample was forwarded to the U.S. Customs laboratory for analysis. Item no. FV-2002064 Apricot Infused Vinegar consists of whole apricots in a liquid medium of vinegar, citric acid, salt, sodium sulfite, sodium benzoate, and potassium sorbate, packed in four-sided, clear glass bottles measuring approximately 17 inches tall. Laboratory analysis found the product to contain 6.2 percent acetic acid. The applicable subheading for Item no. FV-200206 Apricot Infused Vinegar, will be 2001.90.6000, HTS, which provides for vegetables, fruit, nuts and other edible parts of plants, prepared or preserved by vinegar or acetic acid…other…other. The rate of duty will be 14 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
