The plastic bottle with hand pump top is described as a “Personal Portable Air Cooler”. It is also identified as the “Misty Mate Pump”. The purpose is to permit the user to spray a fine mist of water on the person while hiking. You have indicated that the waist bag will be imported both with and without the “Misty Mate Pump”.

Dear Mr. Courson: In your letter dated January 20, 1999, you requested a classification ruling for a waist bag and pump. The sample submitted is identified as the “HydraMistPak”™. It consists of a waist bag manufactured of man-made textile materials and a separate plastic bottle with a specially designed screw top which serves as a hand pump. The waist bag has two zippered storage pockets for personal effects and a pouch for a drink bottle. There are two straps sewn to the bottom which are usually used to hold items such as a rolled jacket or mat. In the instant product the straps are intended to hold the bottle with pump screw top. The plastic bottle with hand pump top is described as a “Personal Portable Air Cooler”. It is also identified as the “Misty Mate Pump”. The duty rate will be 18.8 percent ad valorem. The waist bag falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The applicable subheading for the pump will be 8414.20.0000, HTS, which provides for hand or foot operated air pumps. The duty rate will be 3.7 percent ad valorem. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
