Box 75029 Cincinnati, OH 45275-0029 RE: The tariff classification of a Utility Knife, a Socket Wrench and a Tool/Utility Bag from China Dear Ms. Keller: In your letter dated July 31, 1997 you requested a classification ruling on behalf of Envision Industries Inc., Cincinnati, OH. The articles to be imported are a utility knife, a socket wrench and a tool/utility bag. The utility knife has a reversible rotary magazine containing 15 double-ended factory loaded blades. The knife has a blade carrier button which the user can push to move the blade into the desired position. The article is marketed under the name "NACKKNIFE". Based on Headquarters" Ruling 952988 of 2-4-93, the knife body and the magazine of 15 blades will be classified as one unit. The socket wrench and the nylon tool/utility bag are imported bundled together but they are not put up for retail and will be repacked after importation with other items added. The applicable subheading for the knife body and one blade magazine will be 8211.93.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for knives having other than fixed blades. The duty rate will be 3 cents each plus 5.4 percent ad valorem. The applicable subheading for the socket wrench will be 8204.11.0060, HTS, which provides for hand-operated spanners and wrenches... nonadjustable... other. The duty rate will be 9 percent. The applicable subheading for the nylon tool/utility bag will be 4202.92.9025, HTS, which provides for trunks, suitcases... tool bags... with outer surface of sheeting of plastic or of textile materials... other. The rate of duty will be 19.3 percent. The nylon tool/utility bag falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
