The subject merchandise is stated to contain 45.05 percent cocoa liquor, 40.47 percent sugar, 6.95 percent butter oil, 3.66 percent cocoa powder, 3.12 percent cocoa butter and 0.73 percent soya lecithin. It will be imported in 50-pound cases of chunks. It is intended for use as baking inclusions in cookie and cakes. The general rate of duty will be 10 percent ad valorem. If the quantitative limits of additional U.S. note 10 to chapter 4 have been reached, the product will be classified in subheading 1806.20.8200, HTS, and dutiable at the rate of 37.2 cents per kilogram plus 8.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
