Roll Pisani & Roll 1875 Century Park East Suite 600 Los Angeles, CA 90067 RE: The tariff classification of a 5kV Analog/Digital Insulation Tester from an Unknown Country Dear Mr. Roll: In your letter dated June 08, 2006, for Alcatel Submarine Networks, you requested a tariff classification ruling. No sample was submitted. You stated, “The 5kV Analog/Digital Insulation Tester – Model BM11D is a battery-powered, analog/digital instrument that is housed in a rugged case and is designed for testing the insulation of high voltage electrical equipment. Due to the wide voltage range, it can also be applied to low voltage equipment. The 5kV Analog/Digital Insulation Tester – Model BM11D shows results and test options on a large, clear analog/digital scale for both practicality and precision.” Per the spec sheets you attached, its “basic accuracy” is plus or minus 5 percent of the reading in ohms. We agree that the applicable subheading for the BM11D will be 9030.39.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “other” instruments and apparatus for measuring or checking voltage, current or resistance, without a recording device. The general rate of duty will be 1.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
