Dear Mr. Kenny: In your letter dated March 23, 2020, you requested a tariff classification ruling on behalf of your client, CVS Pharmacy Inc. Images were provided in lieu of a sample. The product under consideration is described as a “Top Bound Twin Wire Jotter Notebook,” CVS item # 556050. The product is available in two designs. The item is a notebook, with twin wire binding, heavy cardboard covers, and 100 ruled pages. It is top bound and measures approximately 8.1 inches by 10.9 inches. In your letter, you suggest classification under 4820.10.2040, Harmonized Tariff Schedule of the United States (HTSUS). We agree. The applicable subheading for the notebook will be 4820.10.2040, HTSUS, which provides for Registers, account books, notebooks, order books, receipt books, letter pads, memorandum pads, diaries and similar articles: Diaries, notebooks and address books, bound; memorandum pads, letter pads and similar articles: Other note books with dimensions of 152.4-381 mm (6" - 15"), inclusive (small side) X 222.5-381 mm (8.75" -15"), inclusive (large side). The rate of duty will be free. Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 4820.10.2040, HTSUS, unless specifically excluded, are subject to an additional 25% percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, 9903.88.03, in addition to subheading 4820.10.2040, HTSUS, listed above. The HTSUS is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
