Dear Mr. Toler: In your letter dated November 2, 2018, you requested a tariff classification ruling. The merchandise under consideration is described as the Polyresin Stacking Animal Décor, Polyresin Memorial Tiding Stone, and Polyresin Nutcracker. Samples were submitted with your ruling request and will be returned to you. The Polyresin Stacking Animal Décor measures approximately 11 inches high by 6 inches wide by 2.25 inches long at its widest points. Classification of the Polyresin Nutcracker in this heading is therefore also precluded. The applicable subheading for the Polyresin Nutcracker will be 9505.10.2500, HTSUS, which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles…: Articles for Christmas festivities…: Christmas ornaments: Other: Other.” The general rate of duty will be Free. Products of China classified under subheading 6810.99.0080, HTSUS, unless specifically excluded, are subject to the additional 10 percent ad valorem rate of duty.  At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.03, in addition to subheading 6810.99.0080, HTSUS, listed above. The tariff is subject to periodic amendment so you should exercise reasonable care in monitoring the status of goods covered by the Notice cited above and the applicable Chapter 99 subheading. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
