N286915 June 29, 2017 MAR-2 OT:RR:NC:N1:117 CATEGORY: MARKING Mark C. Hamilton C.H. Robinson 4563 World Parkway Circle St. Louis, MO 63114 RE: COUNTRY OF ORIGIN MARKING OF IMPORTED CARBON STEEL BUTT WELD FITTINGS AND FLANGES Dear Mr. Hamilton: This is in response to your letter dated May 31, 2017, on behalf of your client, Service Metal Products Co., requesting a ruling on whether the proposed marking is acceptable country of origin marking for imported steel fittings and flanges. A marked sample was not submitted with your letter for review. The products under consideration are carbon steel butt weld fittings and flanges which you indicate will be sold individually to the end user. Your proposed method of marking is to stamp the word “KOREA” along with the heat code number into the metal of each fitting to be imported. The marking statute, section 304, Tariff Act of 1930, as amended (19 U.S.C. 1304), provides that, unless excepted, every article of foreign origin (or its container) imported into the U.S. shall be marked in a conspicuous place as legibly, indelibly and permanently as the nature of the article (or its container) will permit, in such a manner as to indicate to the ultimate purchaser in the U.S. the English name of the country of origin of the article. 19 U.S.C. 1304(c)(1), requires that all pipe (iron, steel, stainless steel), tube and pipe fittings (steel, stainless steel, chrome-moly steel or cast or malleable iron) shall be marked to indicate the proper country of origin by one of five methods, die stamping, cast-in-mold lettering, etching, engraving, or continuous paint stenciling. The proposed method of marking the imported pipe fittings and flanges, based on your provided description, satisfies the marking requirements of 19 U.S.C. 1304(c) and is an acceptable country of origin marking for the imported fittings/flanges. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR Part 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Mary Ellen Laker at [email protected]. Sincerely, Steven A. Mack Director National Commodity Specialist Division
