Dear Ms. Kessens: In your letter dated March 14, 2016, you requested a tariff classification ruling. You have submitted a photo of an outdoor decoration, identified as the Pink Pig Lighted Lawn Ornament with Scarf and Santa Hat. The decoration, designed for temporary display, is a three dimensional depiction of a pink pig wearing a scarf and a Santa hat. The pig measures approximately 24 inches in height and is composed of woven man-made textile fabric over an iron frame, illuminated by 35 LED lights. The LED lighting can be activated by plugging the power cord into an electrical source. You state that this article will only be marketed and sold for Christmas. The applicable subheading for the Pink Pig Lighted Lawn Ornament with Scarf and Santa Hat will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change.
