Dear Ms. Forstenzer: In your letter dated July 16, 2015, you requested a tariff classification ruling. The instant product is called Ferric Carboxymaltose. It is imported in a powder form which is stated to be in a single ingredient form (pure). It will be used in the treatment of iron deficiency anemia. The applicable subheading for the Ferric Carboxymaltose will be 2940.00.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Sugars, chemically pure, other than sucrose, lactose, maltose, glucose and fructose; sugar ethers, sugar acetals and sugar esters, and their salts, other than products of heading 2937, 2938 or 2939: Other”. Pursuant to General Note 13, HTSUS, the rate of duty will be free. This merchandise may be subject to the Federal Food, Drug, and Cosmetic Act and/or The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which are administered by the U.S. Food and Drug Administration (FDA).
