Dear Ms. Hollingsworth: In your letter dated July 10, 2015 you requested a tariff classification ruling. The sample submitted, style SM3736, is a knit bra constructed of 92% nylon, 8% spandex. The bra is two-ply and features elasticized arm openings and shoulder straps and an approximately 1 inch knit bottom band. The applicable subheading for this style will be 6212.10.9020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for brassieres, whether or not knitted or crocheted, brassieres, other, other, of man-made fibers. The rate of duty will be 16.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
