Dear Ms. Hughes: In your letter dated August 22, 2013, on behalf of Godiva Chocolatier, Inc., you requested a tariff classification ruling. You submitted a sample of a “Christmas Stocking” (no item number) that is made of textile and measures approximately 7-7/8” in height x 5” in width. The stocking is red with a white jagged cut cuff at the top. Each jagged point has an attached yellow pom-pom. The stocking has a satin ribbon loop on the top for hanging. You state that the stocking will be empty in its imported condition. A Christmas stocking is specifically cited in the Explanatory Notes to Chapter 95 of the Harmonized Tariff Schedule of the United States (HTSUS) as an exemplar of “Articles traditionally used at Christmas festivities.” The applicable subheading for the “Christmas Stocking” will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change.
