N237583 February 21, 2013 CLA-2-85:OT:RR:NC:1:110 CATEGORY: Classification TARIFF NO.: 8537.10.9070 Mr. Marty Kelly BHC Investment Corp. 10926 David Taylor Drive Charlotte, NC 28262 RE: The tariff classification of a reset device from United States Dear Mr. Kelly: In your letter dated January 22, 2013, you requested a tariff classification ruling. The item under consideration is identified as the “SRR Manual Reset”. Based on the information provided and a phone conversation, the SRR Manual Reset consists of a printed wiring board mounted with relay, switch, lamp and terminal strip housed in a painted steel enclosure. The item is a manual reset used in commercial Automatic Fire Systems to prevent unintended restoration of power to a gas fueled appliance in the event of power failure or fire. When the automatic fire system detects a problem, the SRR Manual Reset will open the circuit, interrupts the power to the gas valve and shuts down the fuel to the appliance. The fuel to the appliance is restored only after the control switch which is connected to the automated fire system is reset. The SRR Manual Reset can be manually reset by pushing the reset switch on the item. The item is rated 10A, 120 or 240 V. You state that SRR Manual Resets is manufactured in the United States with the possibility of export to other countries. Please be advised that classification rulings issued by this office are applicable to the product in question when imported into the United States. Since you also plan exporting the goods, it is recommended that you seek a ruling from the designated customs service of that country prior to export. The applicable subheading for the SRR Manual Reset will be 8537.10.9070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Boards, panels, consoles, desks, cabinets and other bases, equipped with two or more apparatus of 8535 or 8536, for electric control or the distribution of electricity…: For a voltage not exceeding 1,000 V: Other: Other: Other.” The general rate of duty will be 2.7 percent ad valorem.
