Dear Mr. Oh: In your letter dated November 18, 2015 you requested a tariff classification ruling. The merchandise under consideration is referred to as the Drive Box-Injector. This device is described as the electrical connection between the Engine Control Unit (ECU), and the fuel injectors. The Drive Box-Injector consists of a steel housing, connectors, and a printed circuit board assembly, and supplies the voltage necessary for the fuel injectors to function. You state the Drive Box-Injector is equipped with two or more apparatus of heading 8536, and that the device contains a microprocessor but does not perform any data processing functions. In operation, the ECU determines the fuel amount and mixture to be sent to the injectors and sends the signal to the Drive Box-Injector, which in turn issues the necessary voltage directly to the fuel injector. Once the Drive Box-Injector receives the command from the ECU, it delivers the required 10 amps to the injector to dispense fuel. You propose classification of the Drive Box-Injector in subheading 9032.89 Harmonized Tariff Schedule of the United States (HTSUS), which provides for other automatic regulating and controlling instruments and apparatus. However, based on the information provided, it appears that the subject product does not do any type of controlling, but rather merely transmits a signal received from the ECU. The function of this particular ECU is to determine the optimal time and fuel/mixture amount for the injector. Since control such as this is not “designed to bring a factor to, and maintain it at a desired value,” it clearly does not fall within the parameters of heading 9032. As such, the Drive Box-Injector would not be classified within this heading. The applicable subheading for the Drive Box-Injector will be 8537.10.9070, HTSUS, which provides for "Boards, panels, consoles, desks, cabinets and other bases, equipped with two or more apparatus of heading 8535 or 8536, for electric control or the distribution of electricity,…: For a voltage not exceeding 1,000 V: Other: Other: Other." The rate of duty will be 2.7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
