Dear Mr. Mintzer: In your letter dated July 3, 2012, on behalf of Suzlon Wind Energy Corporation, you requested a tariff classification ruling. The item in question is a nacelle assembly for a wind turbine. You state that this assembly will not include an electrical generator but may or may not be imported with blades. The applicable subheading for the nacelle assembly with blades will be 8412.80.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other engines and motors. The rate of duty is free. The applicable subheading for the nacelle assembly without blades will be 8412.90.9085, HTSUS, which provides for parts of other engines and motors. The rate of duty is free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
