A sample was submitted with your ruling request for analysis and will not be returned. Gibberellic acid, in its imported condition, is a separate chemically defined heterocyclic compound. Based on the chemical structure, the product is a nonaromatic lactone for use as a plant growth regulator; pesticide. As stated in your letter, the product will be used to promote cell, plant, and fruit growth. The applicable subheading for Gibberellic acid, imported in bulk, will be 2932.20.5050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Heterocyclic compounds with oxygen hetero-atom(s) only: Lactones: Other: Other: Other. The rate of duty will be 3.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
