The subject product, Namenda®, imported in 7 mg, 14 mg, 21 mg, and 28 mg capsule form is a medicinal preparation containing, Memantine Hydrochloride (CAS-41100-52-1), an orally active (NMDA) receptor antagonist, as the active ingredient. It is indicated for the treatment of moderate to severe dementia of the Alzheimer's type. The applicable subheading for the Namenda® imported in dosage form will be 3004.90.9140 Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments (…) consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses (…) or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the central nervous system: Other.” The rate of duty will be free.
