Dear Mr. Sekiguchi: In your letter dated November 16, 2011 you requested a tariff classification. You provided MSDS sheets for our review. Aron A-10SL is described as acrylic polymer in aqueous dispersion. The product will be imported as an odorless pale yellow liquid for use as an additive in hydrophilic coatings for automotive parts. The applicable subheading for ARONA-10SL acrylic polymer in aqueous dispersion will be 3906.90.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Acrylic polymers in primary forms: Other: Other: Plastics. The rate of duty will be 6.3% ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U. S. Environmental Protection Agency.
