Dear Mr. Cheng: In your letter dated October 20, 2011 you requested a tariff classification ruling. You provided MSDS and technical data sheets for our review. Acrylic Emulsion PCM-1468A is described as a styrene acrylic copolymer emulsion consisting of 47% by weight of acrylic polymer (CAS-39287-83-7) and 53% water. The product is used as a modifier in the manufacture of Portland cement mixtures, interior and exterior repair mortars, tile grout, tile mortars, stucco and floor underlayments for the construction industry. The applicable subheading for Acrylic Emulsion PCM-1468A will be 3906.90.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Acrylic polymers in primary forms: Other: Other: Other. The rate of duty will be 4.2% ad valorem. Duty rates are provided for your convenience and are subject to change.
