Dear Ms. Lee: In your letter dated March 9, 2011, you requested a tariff classification ruling. The sample will be returned to you. The submitted sample is a Printed Fashion Hat (no style number) made of 100 percent polyester knit pile printed fabric and also lined with polyester short pile fabric. The cuffed hat has four panels at the crown. You have also submitted photographs and description information concerning a Russian style fashion hat and a headband, referred to as a Halo. The Russian style fashion hat and the Halo are both constructed of 100 percent polyester knit long pile fabric. No styles numbers were supplied for either article. The applicable subheading for the Printed and Russian style Fashion Hats will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric...Other: Of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: Not in part of braid, Other: Other: Other." The duty rate will be 20 cents per kilogram plus 7 percent ad valorem. The applicable subheading for the Halo headband will be 6117.80.8500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: other accessories: Other: headbands, ponytail holders and similar articles."
