Dear Ms. Pendris: In your letter dated November 5, 2010, you requested a tariff classification ruling. As requested, the sample submitted will be returned to you. Item # 69010 consists of a pair of S/2 Silicone Basting Brushes. Each brush consists of a polypropylene handle attached to a brush head with silicone bristles. The two brushes are packaged together, and measure approximately 8½ inches long by 1½ inches wide. These brushes are intended for use in the act of food preparation and can be used to brush on sauces, melted butter, cooking oil, and more. The applicable subheading for the silicone basting brushes, will be 9603.90.8050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Broom, brushes.…: Other: Other; Other.” The rate of duty will be 2.8% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
