Dear Ms. Stanczak: In your letter dated October 7, 2010, you requested a classification ruling. The sample submitted will be returned. The submitted sample, Style IM106C, is referred to as a “Printed Bra Top” and is constructed of 80% nylon and 20% spandex knitted fabric. The garment features a two-ply constructed front, an elasticized edging that borders the top of the garment, a covered, thick elasticized bottom band measuring approximately three quarters of an inch wide, side seams and elasticized and adjustable shoulder straps. The rate of duty will be 16.9% ad valorem. Duty rates are provided for your convenience and are subject to change.
