The sleeveless halter-style dress features a sturdy neck, waist and seams, defined bust, multi-layer skirt with ribbons that when pulled create a ruche look, sewn-on belt, and lace-like trim. The over-the-dress garment is constructed of woven 100 percent polyester fabric. The garment extends to slightly below the bottom of the dress, has a 6-inch finished collar, long sleeves with ribbons that when pulled create a ruche look, full front opening with no closure, and metallic thread trim. The overall amount of finishing is such that the dress and over-the-dress garment are neither flimsy in nature or construction, nor lacking in durability. The Item # 5027 Vampira Costume consists of two or more garments. Note 14 of Section XI, of the HTSUSA, requires that textile garments of different headings be separately classified, thus preventing classification of costumes consisting of two or more garments as sets. Neither the knit portion, classifiable in heading 6104, nor the woven portion, classifiable in heading 6204, imparts the essential character of the dress. Following General Rule of Interpretation (GRI) 3(c), the dress will be classified in the heading which occurs last in numerical order in the HTS.

Dear Mr. Coppens: In your letter dated December 14, 2009, received by this office on December 24, 2009, you requested a tariff classification ruling. The submitted sample, Item # 5027 Vampira Costume, consists of a woman’s dress and an over-the-dress garment. The dress is constructed of a knit 100 percent polyester fabric bodice and a woven 100 percent polyester skirt.
