The item under consideration has been identified as a Hand Cart with expanding platform (Model # TS40LC). The lower platform, or toe plate, is adjustable to accommodate different size boxes and suitcases. In its compact form the Hand Cart measures 16.5 inches in height but expands to 35.5 inches in height for ease of handling. You state in your ruling request that the cart has a maximum weight capacity of 100lbs. The applicable classification subheading for the Hand Cart with expanding platform (Model # TS40LC) will be 8716.80.5090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Trailers and semi-trailers; other vehicles, not mechanically propelled; … parts thereof: Other vehicles: Other: Other: Other”. The rate of duty will be 3.2%. Some hand trucks imported from China may be subject to antidumping duties or countervailing duties.
