Dear Mr. Ponthieux: This ruling is being issued to correct Customs Ruling Number N040082, dated October 8, 2008. The fabric specifications you provided in your original request were incorrect. On October 22, 2008, you provided us with the correct specifications. A complete corrected ruling follows. In your letter dated September 23, 2008, you requested a classification ruling. The submitted sample is identified as pattern “Burroughs Natural”. It is a jacquard woven fabric composed of 58.3% staple polyester and 30.8% filament polyester. It is a bleached fabric containing 96 single yarns per inch in the warp and 44 single yarns per inch in the filling. This fabric weighs 225 g/m2 and will be imported in 231.14 centimeter widths. The applicable subheading for this fabric will be 5515.12.0090, HTSUS, which provides for other woven fabrics of synthetic staple fibers, of polyester staple fibers, mixed mainly or solely with man-made filaments, other. The duty rate will be 12%. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
