Dear Mr. Ponthieux: In your letter dated September 23, 2008, you requested a classification ruling. The submitted sample is identified as pattern “Burroughs Natural”. It is a jacquard woven fabric composed of 89.1% staple polyester and 10.9% filament polypropylene. It is a bleached fabric containing 96 single yarns per inch in the warp and 44 single yarns per inch in the filling. This merchandise weighs 225 g/m2 and will be imported in 91 inch widths. The applicable subheading for this fabric will be 5512.11.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of synthetic staple fibers, containing 85 percent or more by weight of synthetic staple fibers: containing 85 percent or more by weight of polyester staple fibers, unbleached or bleached, other. The duty rate will be 12%. Duty rates are provided for your convenience and are subject to change.
