Product description
As requested, your sample is being returned to you. The submitted sample, style RO91LRJ, is a woman’s “Curves” brand cardigan that is constructed from a cut and sewn 80% cotton and 20% polyester finely knitted fabric that is napped on the inner surface. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The cardigan features a full front opening with a zipper closure, a 2x2 rib knit turtleneck collar, long sleeves with 2x2 rib knit cuffs, two front vertical pockets below the waist with 2x2 rib knit trim, and a loose-fitting hemmed garment bottom. You asserted classification as a jacket under heading 6202, HTSUS however, the garment is constructed of a knitted fabric and properly classified as a cardigan of 6110, HTSUS. The loose fitting hemmed garment bottom would not provide sufficient protection against the elements to warrant classification as a jacket.
CBP rationale
The applicable subheading for the cardigan will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters…and similar articles, knitted: of cotton: other…other: women’s.
