Dear Ms. Kessler: In your letter dated July 18, 2008 you requested a classification ruling. As requested, your sample is being returned to you. The submitted sample, style 059-0750 (design reference #D4859639), is a woman’s “Eddie Bauer” label cardigan that is constructed from 60% cotton and 40% polyester knit fabric that is napped on the inner surface. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The cardigan extends to the waist and features a full front opening with a zipper closure, a hood with 2x2 rib knit trim, long sleeves with 2x2 rib knit cuffs, kangaroo-style pockets at the waist with 2x2 rib knit trim, and a 2x2 rib knit loose-fitting garment bottom. The duty rate will be 16.5% ad valorem. Duty rates are provided for your convenience and are subject to change.
