Stile Associated LTD 181 South Franklin Avenue Valley Stream, NY 11581 RE: The tariff classification of women’s halter tops from China Dear Mr. Ortiz: In your letter dated July 21, 2008, you requested a classification ruling on behalf of FYC Apparel Group. Your samples will be returned. The submitted samples, styles SL14104/1 and 48740/123456, are women’s halter tops constructed from 100% polyester woven fabric. The pullover halter tops feature a self-fabric tie on the left side of the neck. The halter tops provide insufficient of the shoulders and upper back. The applicable subheading for both styles will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: other. The duty rate will be 16 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Both styles fall within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
