Box 260 Chillicothe, MO 64601 RE: The tariff classification of gloves from China. Dear Ms. Boyer: In your letter dated June 11, 2008, you requested a classification ruling. The submitted samples will be returned. You state in your letter that style 5415A9 contains bamboo. For purposes of this ruling, we are assuming that what you call bamboo is actually an artificial fiber, which is derived from bamboo. The submitted sample “Naturally Green” style 5415A9, is a ladies lightweight work glove constructed of 100% bamboo jersey fabric with a PVC mini-dot coating that has been uniformly applied to the palmside from fingertips to wrist and completely covers the thumb. Based on an informal bench test conducted in-house, we have estimated that the PVC dot coating weighs less than 50% of the knitted palmside fabric. The glove also features fourchettes, an extended cuff, side seams and a hemmed bottom. You state that the primary use of the glove will be garden and yard work. The essential character of the glove is imparted by the knitted coated palmside fabric. We require additional information in order to classify style 152A9. Please provide the fiber content in percentages of each material that makes up the glove. The applicable subheading for style 5415A9 will be 6116.10.7520, Harmonized Tariff Schedule of the United States (HTSUS), which provides for gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: with fourchettes: containing 50% or more by weight of cotton, man-made fibers or other textile fibers, or any combination thereof…subject to man-made fiber restraints. The duty rate will be 13.2% ad valorem. Duty rates are provided for your convenience and are subject to change.
