Dear Ms. Samuel: In your letter dated May 13, 2008, on behalf of Mahco Inc., you requested a classification ruling. The submitted sample is a Style NG-RS-102 Rain Suit consisting of a rain jacket, pants and a drawcord tote bag constructed of a top and bottom layer of nonwoven polypropylene fabric that is laminated to a middle layer of polypropylene plastic, which is a fabric of heading 5603. The fabric is waterproof and breathable. The rain jacket features a collar with a pack-away hood, full front zipper closure, a storm flap with a 5-snap closure, two front slash pockets and elastic cuffs. The rain pants feature an elastic waistband and multi-snap leg openings. The storage tote bag is considered normal packaging.
