The toy cane is constructed of two interlocking pieces of 100% plastic. The cane is black with a gold painted tip and a gold painted double-faced hand grip depicting a skull and a satanic visage. The cane represents the one carried by the fictional character Mr. Hyde. The samples will be returned, as requested by you.

The merchandise that is the subject of this ruling request is identified as a Dick Turpin Pistol, item number 30372 and Mr. Hyde’s Cane, item number 30483. The pistol, constructed of 100% plastic, is a toy replica of the pistol that was carried by Dick Turpin, a famous British highwayman from the 1700’s. The pistol has a solid brown barrel that is decorated with gold painted overlays and parts. The trigger and cocking mechanism have movable parts. The toy cane is constructed of two interlocking pieces of 100% plastic. The cane is black with a gold painted tip and a gold painted double-faced hand grip depicting a skull and a satanic visage. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The submitted samples are not marked with the country of origin. Therefore, if imported as is, the items will not meet the country of origin marking requirements of 19 U.S.C. 1304. Accordingly, they would be considered not legally marked under the provisions of 19 C.F.R. 134.11 which states, “every article of foreign origin (or its container) imported into the U.S. shall be marked in a conspicuous place as legibly, indelibly, and permanently as the nature of the article (or container) will permit, in such manner as to indicate to the ultimate purchaser in the U.S. the English name of the country of origin of the article.” With regards to the Dick Turpin Pistol, imitation firearms must conform to the marking requirements of 15 U.S.C. 5001; 15 CFR Part 1150.
