Dear Mr. McCullough: In your letter dated April 1, 2008 you requested a classification ruling. The sample which you submitted is being returned as requested. The submitted sample Style HUQA191 Hustler Cheerleader Costume is a halter top which you identify as dress made of knit 88% nylon/12% spandex fabric. The garment has a neck strap, partial zipper at the back and laces with metal grommets at the front. The halter top has sufficient bust coverage and extends below the waist. The applicable subheading for the Style HUQA191 Hustler Cheerleader Costume will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Track suits and swimwear; other garments: Other garments women’s or girls’: Of man-made fibers, Other." The duty rate will be 16% ad valorem. The textile category designation is 659. Duty rates are provided for your convenience and are subject to change.
